RYANAIR BOARDING PASS FINE ILLEGAL
Although the company has announced it will appeal the judgement, Ryanair has been dealt a significant blow this week after the commercial court in Madrid ruled that they can no longer charge 40 euro to passengers who forget to print their boarding cards for flights from Spain, which the court considers “disproportionate”.
The Commercial Court No. 6 in Madrid gave the reason for the ruling based on by the OCU consumer association who launched an action against the firm in 2011, in which the group say that a number of practices are “abusive”.
There are eight clauses which the court has deemed unacceptable, which Ryanair said in a statement, the “erroneous” conclusions of the judiciary, and “incompatible with the current legislation on consumer protection”, arguing that “Irish law applies in clauses examined”.
The court dismissed the notion that claims can only be submitted through the courts in Ireland, along with elements of complaint such as schedule changes, luggage costs and the insistence on minors to have their own identity documents, all which have come about following complaints from passengers.
